TurboNIW^™ Refund Policy

0. Packages Covered

This policy distinguishes between: (a) the Petition Package (example forms and petition letter; no RFE-response deliverables), and (b) the Premier Petition Package (our RFE-inclusive tier: educational materials for your petition and, if USCIS issues a Request for Evidence (RFE), for your RFE response). Your eligible refund depends on which package you purchased, as described below.

1. Petition Package — Rejection Protection (Initial Denial)

If you purchased the Petition Package (without the RFE Response tier) and your NIW petition is denied by USCIS without TurboNIW having delivered any RFE-response educational materials to you, you may request a refund if all of the following conditions are met:

• You filed your petition within 60 days of receiving the applicable educational materials from TurboNIW;
• You provide a copy of the USCIS denial notice within 30 days of the denial date; and
• You provide the date your petition was filed.

To request a refund, email contact@turboniw.com with: (a) subject line "Refund Request --- [Your Name]"; (b) copy of USCIS denial notice; and (c) date petition was filed. TurboNIW will review and notify you of the decision within 15 business days. If approved, a 100% refund of the service fee paid to TurboNIW for the Petition Package (excluding payment processing fees) will be issued via the original payment method within 10 business days. USCIS filing fees are non-refundable.

Important: For the Petition Package, refunds do not apply if USCIS issued a Request for Evidence (RFE), a Notice of Intent to Deny (NOID), or if the denial follows an RFE or NOID, or if TurboNIW has already delivered RFE-response materials under a different purchase. Those situations are covered only under Section 2 if you purchased the RFE Response tier.

2. Premier Petition Package — Tiered Refunds

If you purchased the Premier Petition Package (RFE-inclusive tier), the following applies in addition to the procedural requirements in Section 1 (filing within 60 days of receiving materials, denial notice within 30 days, and petition filing date documentation), unless otherwise stated below:

• Full (100%) refund of the service fee (excluding payment processing fees): If USCIS denies your petition without TurboNIW having delivered any RFE-response educational materials to you (i.e., a denial on the initial decision, with no RFE-response deliverables from TurboNIW).
• Half (50%) refund of the service fee (excluding payment processing fees): If USCIS issued an RFE, TurboNIW delivered RFE-response educational materials to you, and USCIS subsequently denies the petition.

Refund requests for this tier must follow the same email process as Section 1. TurboNIW will verify package tier, delivery of materials, and denial circumstances before approving any refund.

Refunds under this section do not apply to NOIDs, USCIS delays, filing errors, petitions filed more than 60 days after delivery of educational materials, requests made more than 30 days after denial, or materials based on incomplete information you provided—except where Section 1’s procedural conditions are satisfied and the denial scenario matches the bullets above.

3. Refund Exclusions (Summary)

Except as expressly stated in Sections 1 and 2, refunds do not apply to:

• Change of mind or dissatisfaction with the Service;
• Approval or withdrawal of a petition without a qualifying denial;
• USCIS delays not involving a qualifying denial under Sections 1–2;
• Filing errors attributable to you or third parties;
• Petitions filed more than 60 days after delivery of educational materials;
• Refund requests made more than 30 days after denial date; or
• Educational materials based on incomplete or inaccurate information provided by you.

4. General Refund Policy

Except as provided in Sections 1 and 2 above, all payments made to Sanqi Consulting LLC, operating TurboNIW^™, are final and non-refundable. This includes:

• Change of mind or dissatisfaction with the Service;
• Failure to complete surveys, upload evidence, or provide requested information;
• Decision not to file a petition after receiving educational materials;
• Technical issues caused by user error or third-party service interruptions;
• Account termination for violation of our Terms of Service; or
• Any other circumstances not specifically covered in Section 1.

5. Service Delivery

TurboNIW will deliver educational materials within 30 days after receiving all required information from you. Service obligations end upon delivery of educational materials. You are responsible for: (a) completing all required surveys within 14 days of purchase; (b) uploading all evidence documents within 14 days of purchase; and (c) responding to any clarification requests within 14 business days.

5. User Responsibility

You are solely responsible for:

• Understanding the Service scope prior to payment;
• Providing accurate and complete information;
• Preparing your own petition using educational materials as reference;
• Reviewing all materials before filing with USCIS; and
• Filing your petition with USCIS and paying all USCIS fees.

7. Chargebacks and Payment Disputes

Initiating a chargeback, dispute, or payment reversal without first following the refund request process outlined in Sections 1–2 violates this Refund Policy and the Terms of Service. In such cases, we reserve the right to immediately suspend or terminate your account and pursue all available remedies under applicable law.

8. Governing Law and Dispute Resolution

This Refund Policy is governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles. Before formal proceedings, parties agree to attempt good-faith resolution for 30 days. If resolution fails, any dispute or claim relating to payments or refunds shall be resolved through binding arbitration in Atlanta, Georgia, under the rules of the American Arbitration Association (AAA), except disputes involving intellectual property or confidentiality may be brought in state or federal courts in Fulton County, Georgia. You waive all rights to jury trial or participation in any class action. The prevailing party may recover reasonable attorneys' fees and costs.
